What is Safe Harboring Solar and What are Tax-Advantaged Projects?
Safe harboring is a well-established IRS mechanism that allows a qualifying commercial solar project to “lock in” tax credits at the time the project is safe harbored, even if construction is completed later. For example, a project safe harbored in 2025 remains eligible for 2025 tax credit rules, provided it meets IRS requirements, even if it isn’t placed into service until 2029.
Before the federal deadline, Namaste Solar strategically safe harbored a limited portfolio of commercial solar projects across a range of system sizes. With these tax-advantaged projects, qualifying commercial property owners can still access benefits that are no longer available to other new projects, including:
- Accessing the 2025 50% tax credit through the federal tax credit, using domestic content, and additional adders.
- Avoid the newer Foreign Entities of Concern (FEOC) rules that apply to many projects moving forward.
- Take advantage of greater flexibility on install timing, with projects able to be placed into service through the end of 2029.
